BOSTON — In response to relentless, shameful attacks on the defense bar and its constitutional function, the Massachusetts Association of Criminal Defense Lawyers today released the following statement: The Massachusetts Association of Criminal Defense Lawyers objects to statements made in the current campaign for governor suggesting that persons who perform the constitutionally mandated role of attorney for the defense in criminal cases are unfit for or disqualified from public office. John Adams, our second president, and Abraham Lincoln, the first Republican president, were each proud of their service as criminal defense lawyers. They properly understood it and revered it as an important contribution to the public good. No one in 1796, 1860 or 2006 can claim that such service in any way disqualified Adams or Lincoln from holding our highest office. An assertion that todays criminal defense counsel have acted contrary to the public interest and should not be trusted to serve in government is un-American and demonstrates either a profound contempt for, or ignorance of, our system of governance. The right to jury trial, the only right twice guaranteed in our Constitution, is the purest form of democracy - the people, as a jury, govern. Our jury system requires zealous prosecution and defense, confident that citizen jurors will do their human best to arrive at a just verdict.

Many nurses may be familiar with life coaching or executive coaching. Coaching is a partnership between coach and client. The coaching process is designed to support clients as they work toward fulfilling personal and professional goals. While life and executive coaching may be the most well-known forms of coaching, the approach and methods of coaching have been extrapolated into other areas or niches. One of these is AD/HD coaching. “A designed partnership that combines coaching skills with knowledge of attention deficit disorder, a neurobiological condition. The coaching process enhances quality of life, improves performance, and supports growth and change. The purpose of AD/HD coaching is to provide support, structure, and accountability. Coach and client collaboratively explore strengths, talents, tools, and new learning to increase self-awareness and personal empowerment. Together they design strategies and actions and monitor progress by creating accountability in line with goals and aspirations” (IAAC, 2007). AD/HD coaching was brought into the spotlight as an intervention for the treatment of adult AD/HD by Hallowell and Ratey (1994) in their seminal book, Driven to Distraction. At that time, professionals focused mainly on educational accommodations and therapy for children and teens with AD/HD. Little had been written about coaching for youth with AD/HD, and the focus on youth coaching was centered on academics. Academic and educational coaches were available to students needing support, with a strong recommendation of academic coaching for struggling students with AD/HD and learning disabilities. Help4ADD@HighSchool (Nadeau, 1998) was one of the first books to discuss AD/HD coaching on a larger scale, reaching beyond simply academic coaching. In her book, Dr. Nadeau states, “Coaching is one of the best ways to deal with your ADD. A coach provides external structure and support, and teaches [you] how to develop your own internal structure” (p. 62). Coaching helps children and teens with AD/HD with several key challenges they face. First, coaching helps a child/teen learn techniques for maintaining focus, stay on task, and improve time management and organizational skills. The development of these skills can contribute to smoother family life and improved school performance. These skills are also the building blocks for future success. Second, by initiating the coaching process with school-aged children, coaches are able to help students with AD/HD avoid frustration and keep motivated, as well as help them build self-confidence and self-awareness during the formative years. Third, most children benefit from daily routines and structures, and building structure and predictability through routines is an effective tool for parents of challenging children with AD/HD (Heininger Weiss, 2001). Yet, routines can be difficult for the child with AD/HD to maintain, and a busy parent can easily be thrown off a routine when a child has AD/HD. Additionally, many parents of children and teens with AD/HD have attentional issues themselves and find it difficult to keep up with a plan on a daily basis. With the support of a well-trained AD/HD coach (IAAC, 2007), effective structure and routines can be developed and sustained, facilitating the consistency that allows children with AD/HD and related behavioral issues to thrive. This can be done with support, care, and humor to protect and build the self-esteem of everyone involved.

In a time when travel trends come and go, at least
one company has staying power: Cruise America RV . Celebrating its
35th anniversary this month, the organization is one of the oldest RV
rental and sales companies in the world.

Cruise America has grown dramatically over the past three-and-a-half
decades. From its roots in Florida, where Robert Smalley, Sr. — a former
president of car rental giant Hertz — first opened up shop in 1972, the
company has expanded from a small family operation to the largest RV rental
company in the U.S., as well as one of the top sellers of used Class C motorhomes .

In 1993 Cruise America shifted operations to Mesa, Ariz., where it is still
located today. Now operating 136 RV rental
locations and 16 motorhome sales
centers throughout the U.S. and Canada, the company has served nearly 1
million rental customers and sold more than 25,000 used RVs over its
35-year history.

Despite its rapid growth and national success, Cruise America still
maintains its family-oriented focus. Top executives at the company include
Robert Smalley, Jr. and Randall Smalley, both sons of founder Robert
Smalley, Sr., with other family members holding key positions as well.

“Family ties have been integral to Cruise Americas success since the
start,” says Robert Smalley, president of Cruise America. “Were a
close-knit company, and we believe that this focus makes us better able to
serve our customers, many of whom are families as well.”

ST. PAUL, Minn. — The Retail Sales Finance unit of GE Consumer Finance has announced a new credit card for the recreational vehicle industry. The MileMarker(R) card is now available to RV owners through authorized RV dealers across the country. “The MileMarker card is a revolving credit tool that retailers can use to build customer loyalty and increase sales,” said Gary Slagle, vice president, RV/Marine industry for Retail Sales Finance, part of GE Consumer Finance. “The card enables dealers to offer innovative promotions and flexible payment options, while giving their customers greater purchasing power.” Unlike most major credit cards, the MileMarker card has no processing fees for dealers. Additionally, consumers can put all their RV related purchases on a single card while keeping other credit lines available, so its a win-win for both the customer and the dealer. Application paperwork is minimal and the credit decision process is fast, usually within minutes. “We want the application and decision process to be as quick and easy as possible because we know how important it is for the dealer to manage the sale,” said Kevin Chase, Marketing Manager. “The new MileMarker card was designed for use throughout a dealership from the purchase of small pop-ups and campers to service, parts and accessories. With the dealership name being embossed onto the card, it will help to strengthen the link between the customer and the dealer.”

The Capital-Journal Applications are no longer being taken for one-room air conditioners being provided through Project Neighborhood Relief because the number of applicants exceeds the number of available air conditioners, city of Topeka spokesman David Bevens said Thursday. Bevens said the names of those who want an air conditioner will be put on a list and one-room, window air conditioners will be distributed to them on a first-come, first-serve basis if they become available. Fans will go to those who dont get an air conditioner, Bevens said. City officials and their partners with Lets Help - the American Red Cross, Older Citizens Information and the Jayhawk Area Agency on Aging - announced last week they would give away the fans and air conditioners to eligible applicants on days hot weather forced the activation of Project Neighborhood Relief. That project was activated Wednesday and again Thursday . Also on those days, Bevens said, six of the citys community centers were designated as “cooling” centers and opened to the public beyond their normal hours.

Some physicians who perform only tumescent liposuction question the benefits of and need for laser lipolysis. I acknowledge that we are still gaining experience with laser-assisted liposuction, and that there are many technologies, such as ultrasound, that have come and gone with liposuction to try to facilitate the procedure. But the improved cosmetic results that can be obtained with laser-assisted liposuction and its safety record so far seem to point to an expansion of its use. The crisscross pattern of cannula movement used in normal liposuction often leaves pockets of fat behind that cannot be removed, but a laser can liquify these areas. In addition, the skin overlying the areas of fat removal contracts because the laser coagulates the tissue, inducing collagen retraction and tightening of tissue. This effect is an added benefit that is especially useful for liposuction candidates who would be able to reduce their fat volume with normal liposuction but would not have accompanying skin contraction. The laser can break up fibrous tissue for scar subcision and be used without suction for the reduction of small areas of fat. We may also see a reduction in bruising and postoperative pain. Some studies have found that laser-assisted lipolysis and liposuction produced less bleeding than did liposuction alone. Histologic analysis of laser-assisted lipolysis using 1,064 nm have shown coagulated blood vessels and a reorganization of the reticular dermis and collagen without nerve damage. Scanning electron microscopy images have shown specific ruptured adipocytes.

Protecting businesses with mutual interests Commercial property insurance usually includes provisions that permit an agreement by the insured with another business or entity that has the effect of barring subrogation against the other party by the insurer. Subrogation occurs when, following payment of loss to its insureds property, an insurer seeks recovery from a source that it deems liable for that loss. If an insured has rights of recovery against another party, those rights are transferred to the insurer when the insurer indemnifies the insured for its loss. The transferred rights extend to the amount of the payment made by the insurer. After receiving insurance payment and transferring rights, an insured must do everything necessary to secure and protect the rights of the insurer and must not impair those rights after a loss has occurred. The insured, however, may waive the rights against a specified party subject to the following conditions:

ADVERTISING MEDIAAUDIOThe most common audio advertising media is FM radio. Placement of an advertisement on FM radio costs about as much as an advertisement placed in a metropolitan newspaper. However, radio is more dynamic than print alternatives because it allows the advertiser essentially to talk with the consumer. Indeed, many small business consultants believe that an entertaining and informative radio advertising campaign can be a major asset. Nonetheless, some analysts contend that small business owners should proceed cautiously before deciding to rely exclusively on radio advertising. Indeed, most businesses incorporate a media mix when attempting to sell their products or services, utilizing radio advertising in concert with print and other advertising media. The key for small business owners is to study what types of advertising best suits their products and services and to use that media to spearhead their advertising campaign.Radio stations feature many different programming emphases. These range from music-oriented formats such as country, adult contemporary, classic rock, and alternative rock to news-or talk-oriented formats. Since these different formats attract different demographic segments of the total audience, business owners can take appreciable measures to reach their target audience simply by buying time on appropriate stations. Another major advantage of radio advertising is that it is inexpensive to place and to produce, allowing small business owners to place advertisements on more than one station in a given market. In addition, radio advertising content can be changed quickly to meet changes in the market or to reflect new business objectives. Finally, radio reaches large numbers of commuters, income-generating people who often pay more attention to radio advertising than to other advertising media, especially if they are driving alone. The costs associated with purchasing radio advertising time reflect this emphasis on reaching the commuter audience. The four time slots, or dayparts, offered for advertisers by most radio stations are the morning drive, daytime, afternoon drive, and evening. The two most expensivebut also most effective advertising slotsare the morning and afternoon drive times.

The doctrine of educational malpractice is, not surprisingly, an American construct. Generally speaking, US tort law is a number of years ahead of the curve, particularly when compared with Canada. Some Canadian court decisions, however, have opened up the possibility that a plaintiff could be successful, given the right set of facts, in claiming educational malpractice. That possibility, along with the knowledge that claims for educational malpractice have been successful in the United Kingdom, means that the issue of educational malpractice warrants careful consideration. What is educational malpractice? Educational malpractice is a legal claim based in the tort of negligence, specifically professional negligence. The British Columbia Court of Appeal in a case called L.R. v. British Columbia notes that educational malpractice has been defined as “the failure to impart knowledge or teach practical skills”. Claims of educational malpractice may be directed against individual teachers as well as the school boards or post-secondary institutions that employ them. They all arise, however, from the claim that educators negligently failed to impart their knowledge to those in their classes. To date, claims for educational malpractice have met with little if any real degree of success in Canada. In the past, plaintiffs have claimed educational malpractice for a variety of alleged wrongs including failure to teach 30% of a Social Studies class and failure to provide “proper education and corrective instruction.” Traditionally, courts have dismissed these claims on the basis that the tort of educational malpractice is not a recognized cause of action in Canada. In the United States, claims of educational malpractice have had mixed success. One of the leading US cases that deals with educational malpractice is a well-known 1976 decision of the Court of Appeal of California called Peter W. v. San Francisco Unified School District. This case is important in the Canadian context as it aptly describes some of the policy reasons underlying the reluctance of Canadian courts to entertain claims of educational malpractice.

Curad, maker of adhesive bandages, in conjunction with the American Safety Health Institute (ASHI), surveyed 200 first aid trainers concerning the general publics knowledge and preparedness when it comes to first aid. “When faced with a first aid emergency–no matter how minor or severe–our members say the biggest mistake people make is that they panic,” indicates paramedic Ralph Shenefelt, general manager of ASHI. “By learning basic first aid and having the proper supplies to deal with minor first aid situations, the panic factor could be eased dramatically. “According to the survey, trainers report that only 10% of those who seek basic first aid training classes actually own a first aid kit prior to taking the class,” he reports. “It shows you that even people who realize basic training is important are not always prepared.” Shenefelt advises that, in order to stay calm and take care of a minor emergency, the two–knowledge and supplies–go hand in hand. Among the findings in the ASHI/ Curad survey are: The most-common first aid mistake. If they had to choose one, 32% say the number-one mistake made by the public is that they panic, even in minor first aid situations: 24% maintain that most people do not know what to do; 24% indicate that most people do not have the proper first aid supplies on hand; and 20% argue that people favor first aid myths over standard, proven first aid procedures. What the experts recommend in a first aid emergency. Besides learning first aid skills, 37% recommend keeping calm when confronted with a first aid emergency; 35% say keep the correct supplies on hand; and 27% suggest calling 911 if you arent sure what to do.

* Heres an alternative to conventional curtains: Interior designer Star Pierce created a flexible, multifunctional window treatment by using several contrasting sheer fabric panels on a single curtain rod, where they combine to form a striped pattern. You can change the effect on a whim–to accentuate a color, simply spread a curtain panel wider. The simple treatment is created with ready-made sheers, or curtain panels made from thin fabric. The panels are usually sold in pairs and come ready to hang with fabric sleeves, loops, or ties. Although heavier curtain fabrics can be used, Pierce selected sheer fabric because it lets in light while covering the window. The treatment is more than decorative: “On a bank of windows, these curtains can be adjusted in many ways to control light or screen a view,” says Pierce. “You open the curtains on two sides or in the middle.”

Below is a summary of Alex Sheshunoff@ remarks at the KBA Convention. Recognizing and responding to windows of opportunity require an excellent sense of timing. Indeed, some people think that timing may be the all-important factor in determining business success. Timing involves seeing an opportunity, developing a response, and acting on it quickly, when a window of opportunity opens and before it closes. In todays financial services environment, three windows are wide open right now. Window of Opportunity I - Planning to Win; Window of Opportunity II - Customer Relationship Management; and Window of Opportunity III - Total Internet Banking Solution. The old way of strategic planning simply will not adequately prepare a bank to win in todays dramatically changing environment. Banks throughout the country are rethinking their strengths and weaknesses, opportunities and threats, and future decisions. Bringing together highperformance information, competitive intelligence and new business models is a management priority.

PAT Testing Leeds

June 25th, 2009

In addition to these tests, which I refer to as “electrical integrity testing,” an acceptance testing program should include verification of mechanical integrity and functional performance. Mechanical integrity includes verifying that the equipment is properly installed, connections are tightened properly, and mechanisms are properly adjusted, etc. Functional performance verification applies to any operation, interlock, or control system that requires a step-by-step procedure for testing, such as bus transfer schemes or ground fault protection. The goal of acceptance testing is similar to that of preventive maintenance: to identify and prevent potential unscheduled failure of the equipment while in service. The decision process for the scope and extent is also similar: The cost of testing should be justified by the avoided cost of an unscheduled failure or its impact on personnel safety and the mission of the facility. In most facilities, the cost of testing every single motor or branch circuit breaker would not be justified, although in a critical data center or semiconductor production facility it may be. While the extent of testing is facility specific, the following systems and equipment in typical commercial facilities are normally included: all medium-voltage (Over 600-V) equipment; the main electrical service switchboard; the grounding system; the emergency power system; the fire detection system; and large motors and starters, such as chillers.

The Western Magazine in 1881 pictured a prosperous Mennonite colony in Harvey County. Russian-German farmers preferred to group their homes in villages and commute to the fields. Accustomed to severe Russian winters, the early Volga Germans to arrive in Kansas wore large coats and head coverings much heavier than the Kansas climate required. The two main concentrations of Russian-German settlement in Kansas were the Mennonites in Marion, Harvey and McPherson counties and the Volga Germans in Ellis, Russell and Rush counties.

weight loss tips

June 25th, 2009

A recent investigation was designed to see whether a phenomenon similar to naturally occurring relapse might be produced experimentally in a shorter time period by intentionally interrupting weight loss momentum during the initial treatment period. Investigators felt that artificially forcing weight stabilization might allow them to produce experimental relapses in a shorter time frame than occurs naturally during treatment. The purpose of the study was to experimentally test this disruption hypothesis by randomly assigning some patients to interventions that would disrupt their weight loss momentum. Subjects included 142 men and women (22 males and 120 females), aged 25 to 60 years with a mean BM1 of 33.1 [+ or -] 3.3 kg/[m.sup.2]. Subjects were randomly assigned to one of three groups that differed in the scheduling of the 14 group lessons. The control group completed 14 sessions, on 14 consecutive weeks. The long break group (LB) took a 6-week break after the seventh lesson. The short break group (SB) took 2 week breaks after the third, sixth, and ninth lessons. Participants in all groups were assessed at postreatment (week 20) and 6 months later (month 11). The three groups received the same behavioral weight loss intervention consisting of 14 group meetings. The subjects were also assigned a calorie goal of 1000 to 1500 calories per day depending on their baseline weight. Additionally, to create a formal rule for `break, participants were given a list of 13 high-fat foods that were to be totally restricted (for example, cheese, burgers, cakes, and pastries). Exercise was gradually increased up to 150 rain of activity per week. There were no group meetings during breaks and participants were instructed no to monitor their behaviors or weight during these breaks and to eat and exercise as they had before the program. Following the `breaks, treatment meetings began where they had left off. After completing the 14 lessons, all participants were encouraged to maintain their new eating and exercise habits and continue to lose weight or maintain their weight loss. The subjects appeared to take the breaks as prescribed, with interruptions in self-monitoring, dietary adherence, and self-weighing (but not exercise). However, participants quickly resumed their weight loss behaviors after the break. Breaks produced a slowing of weight reduction or slight regain, but weight losses during the breaks were not significantly different from the control group. Overall weight losses (0 to 5 months or 0 to 11 months) did not differ between the treatment groups.
